The top side is where the data is. Everything down from there is just
filler.
When a CD is manufactured, the data is stamped into pits on the top
surface, which then receives the reflective coat, topped by labels and
lacquer. So if you scratch the top, the data is gone. Scratches on the
bottom, however, can be polished out with toothpaste.
As Dario notes, you might find that the lost data is not part of the
recording. Most $15 CDs are only half full.

It should not, but only if the scratched zone was used. CD begin in the
center and expand outwards. If it was not filled up, it may be ok. DO
immediately a copy!!
